The Will of Sir William Godolphin of Godolphin

body indisposed but (laud unto the Eternall Trinitie in mynde well resolved of the uncertaine Condicion of
mans frayle estate Doe Declare this my last Will and Testament, And First of all I Doe humbly crave mercy
of my Creator for my unadvised act in burninge att my now cominge from London my Draught for the
Disposicion of that estate whereof he hath made me temporary Steward and Disposer which I Confesse
unto the worlde I did upon advise that the same was insufficient in forme of lawe, but with a full purpose
att this my retorne home to have effected and perfected The same in dew forme of lawe, for the Doeinge
whereof not haveinge now sufficient tyme I Doe notwithstandinge make this Declaracion of my foresaid
full purpose and intention, and will that the same be put in writinge, and that it stand for my last will which
I hartily praye my deare brother Frauncis Godolphin and all my good Freindes whome I Doe intrust to use
theire best endeavours to see, to be, in all poyntes performed. And First I bequeath my transgressing soule
unto my all sufficient Redeemer and my mortall parte my body I give unto Christian buriall, in such devout
forme and order as unto my Executors shall seeme fittinge next for the settinge my worldly estate my will
is, And I Doe hereby Declare and manifest my intencion to be as followeth. Viz I Doe hereby graunt and
bequeath unto my Brother Frauncis Godolphin my Demeasnes Mannors messuages landes Tenementes
and hereditamentes with theire appurtenances whatsoever, and wheresoever, within the Countie of
Cornewall. And alsoe the use proffitt issues advantages and Commodities of all my Chattell leases aswell
of the Isles of Sylly as any other whatsoever or wheresoever else where within the said Countie of
Cornewall, And allsoe The full use benifitt and proffitt of all my mynes and Tinnworkes whatsoever within
the said Countie, To have holde and inioy the same unto the said Fraunces Godolphin my said Brother for
the full tyme and Terme of fowerteene Yeares from the Day of my Death fully to be compleat and ended
under a suer and undoubted trust and confidence which I repose in him that he will carefully and faithfully
by and with thadvice and assistaunce of my Cosen John Coke maunage order governe and dispose of the
same, as a lovinge Father for the good of my Children, And for the full performaunce of all such other
purposes and intencions as I shall now manifest and Declare, That is to saie, First and principally that out of
the issues and meane proffittes thereof hee doe Yearely satisfie and paye such pencions Rentes and
Annuyties as my late Father Sir Frauncis Godolphin knight deceassed hath charged uppon me Amongest
which Cheife and principally are these, Viz to my mother in lawe the lady Allice Godolphin per Annum
Three hundred poundes during her life. To my brother John Godolphin and his heires forever one hundred
poundes per Annum, And to my Sisters Elizabeth Godolphin and katherine Godolphin, duringe theire living
sole to either of them Fortie poundes per Annum and theire Dyettes or Tenne poundes per Annum for the
same per Annum accordinge to my said Fathers will, and such other Rentes and Duties as of for and out of
the same are Yearely to be satisfied, Secondly that he take out of the same yearely such reasonable and
compoten porcion as in his Discretion hee shall esteeme fittinge for the honest and seemely
mayntaynamence and educacion of my Children and for his owne mayntaynaunce and expences in and
about the maunage of my estate, And out of the overplus thereof That the content satisfie and paye all
such Debtes as I shall iustlie owe at the tyme of my Death and such legacies I shall and doe give in such
speedy and and (sic) convenient sorte as the same shall or maye be raysed out of my estate and the
profittes thereof. The principall of my said Debtes are unto my my (sic) forenamed two sisters to each of
them one Thowsand poundes at such tymes as in my said Fathers Will are expressed, And unto the
Agentes for Tinn what uppon accompt (my Tinn allowed) shall appeare to be due unto them Into whom I
have transferred all the grosse of my Debtes, prayinge my said Brother that for theire Better assuraunce of
what shall be found iustlye to be Due unto them, and for what he shall hereafter receive of them by way
of Supplye for my ball, that he passe and Convey unto them (yf they shall Desyer it) his said terme or such
parte thereof as he shall iudge to be equevalent to theire Debtes of and in the mynes of Godolphin and
the leadworkes att Penrosse (which said leadworkes I have by especiall graunt passed unto him my said
Brother reservinge unto himselfe notwithstandinge, the Maunage goverment and Direction of the said
Tynnmynes and leeadworkes, Item my Will is that there shalbe a Thowsand pounds in present made upp of
my Howshould goodes and Chattells personall and issues and assigned as a porcion for my Daughter
Penelope which may bee laid out for her and grow with hir for her best advantage and increase, Withall
leavinge it in the power, and att the discrecion of my Brother Fraunces Godolphin and prayinge him to
enlarge the same, if, and when he shall finde that by the blessinge of the Allmightie God (on which the
preservacion of our family hath for many Discentes espetially depended) the same may be raised out of
the Issues of my said livelihood unto which my said Daughter Penelope I Doe allsoe give and bequeath the
Godolphin, which Jewells nowe are in the Custodie of my Sister Elizabeth Godolphin, This beinge
performed then my will is , That my said Brother Fraunces Godolphin Doe satisfie Discharge and paye all
such legacies and bequeathes ad pios usus (to pious uses) and others as my late Father in his will hath
charged and given, And all other suche guifte legacies and Annuyties as I shall give and Declare before my
Death, For the better performaunce whereof my Hartie Desyer unto my said Brother Fraunces Godolphin
is, that he use his Carefull indevore to procure the Wardship of my Heire de herede in heredem (from heir
to heir) which beinge obtayned that then he would Convert to the uses above limited, the meane proffittes
of all such landes in Norfolke as are unto him Discended from his late mother my late Dearely beloved
Wiffe Thamasine Godolphin daughter and sole heire to Thomas Sidney of Weighton Esquier, Concerninge
my estate of inheritance and Chattells reall my Will is and I Doe now Declare that accordinge unto and in
performaunce of my late Fathers Desyer in his last will and Testament expressed I doe suffer to discend
unto my sonne Frauncis Godolphin and his heires males for ever my manor and Demeasnes of Godolphin
with all the members and partes thereof and all other thappurtenaunces whatsoever to the same
belonging, And withal Doe further give and bequeath unto my said sonne Fraunces Godolphin and his
heires males for ever And in Defaulte of his heires males unto my next heire male and his heires males for
ever, All those my Mynes of Tynn and Tynnworkes and boundes of Tynnworkes Commonly called and
knowen by the name of Godolphin Ball with their appurtenaunces whatsoever, the former lease thereof to
my said Brother Fraunces Godolphin reserved foreprised and excepted, And my intente and will further is
that my Barton of Kirthon my woodes called Boswithgy woods my fowerth parte of the Mannor of Lelant
on this side the river of Hagley my sheaffe garb and Rectory of Mevagissy and all other my inheritable
landes which alsoe ( saveinge and exceptinge what I have and doe Designe Condicionall uppon my seconde
Sidney Godolphin) shall likewise descend unto my said sonne Fraunces Godolphin and his heires males for
ever, All which in his Default of his issue male my Desire is that they likewise Descend and be together
with my said Mannor and Demeasnes of Godolphin and my mynes Tynnworkes and boundes Called
Godolphin Ball unto my next heires males for ever, Item for provicion and preferment of my second sonne
Sidney Godolphin my will and Desire is And I doe require and request my sonne and heire Fraunces
Godolphin that after he shall accomplishe the age of one and Twentie Yeares he persew and sew out his
Livery with all Convenient speede and the same beinge soe Donn and he thereby by the lawes of the lande
inhabled to Despose of his inheritance Doe then with Convenient expedicion passe assure and convey by
sufficient and indefesible Conveyance in the lawe an estate in Fee tayle unto his said Brother Sidney
Godolphin and his heires males for ever of and in all Those messuages landes Tenementes and
hereditamentes whatsoever within the Countie of Norfolke which are descended unto him the said
Fraunces as heire unto his late mother, And wherof hir Father Thomas Sidney aforesaid died seised, And
alsoe of and in that one mill in Weighton in the said Countie of Norfolke aforesaid Commonly called and
knowne by the name of Tynnmyll which I there lately purchased to me and my heires for ever of the late
Contractors with the kinges maiestie for Milles which said landes and Mill in Norfolke if my said sonne
Fraunces shall sufficiently assure and Convey unto my sonne Sidney Godolphin as is aforesaid then my Will
and Desire is That all my mannors Demeasnes and all other my Messuages landes Tenementes and
hereditamentes whatsoever in Truthwall Rosevenny Trevarthen Brevanneck and Trenearth shall likewise
descend and come unto my sonne Fraunces Godolphin and his heires males for ever, But if my said sonne
Fraunces shall not convey the landes in Norfolke aforesaid to him Descended from his said mother unto
his said brother Sidney Godolphin as is by me desired and limited, Then my will is that my said son Sidney
Godolphin shall have and enioye to him and his heires males for ever for his and theire porcion and
livelyhood All those my Mannors of Trevarthen Brevanneck and Trenearth with theire members and
appurtenaunces whatsoever, And all that my Mannor of Truthwall and all those my Barton Demeasnes
Messuages Tenementes Woodes and Mills in Truthwall Rosevenny and Harrington woode with theire
members partes and appurtenaunces whatsoever, All which my purpose was by sufficient Conveyance in
the lawe to have before this tyme Conveyed under Condicion as aforesaid for provicion of my said sonne
Sidney Godolphin if my instructions therein had bynn Dewly performed, And therefore in Default thereof I
Doe require and before eternall God Charge my said sonne and heire Fraunces Godolphin that when and
assoone As he shalbe by the lawes of the land enhabled to doe the same, as he hopeth to be partaker of
Gods blessing uppon him that he performe this my Desire for the provicion of his said brother Sidney
Godolphin my second sonne, And I Doe withal require and request my said Brother and Executor Fraunces
Godolphin and his substitute Executors Sr Robert Killygrew knight and my Cosen Fraunces Bassett and
every of them, that if my said sonne Fraunces Godolphin shall not performe this my Desier in this poynte
expressed, That then hee and they extend and use the uttermost of his or theire powers of Executorshipp
to enforce my said sonne Fraunces Godolphin thereunto or otherwyse to make unto the said Sidney by all
meanes he or they may or cann out of my Goodes and Chattells Devisable by will and out of the issues of
my mynnes and revenew of my liveinge an estate equevalent thereunto or such sufficient recompence in
proporcion of livelihood for the same as to my said Executors respectively shall be thought fittinge for my
said second sonne Sidney Godolphin haveinge eie unto my Designe uppon him , Moreover I Doe give and
bequeath unto my said second sonne Sidney Godolphin my lease for terme of Yeares which I have for
Certaine landes Called Crabbs Castell within the said Countie of Norfolke in Revercion of one Lott now
tenaunt thereunto, Item I give unto my Third sonne, William Godolphin the remainder of Yeares which
shalbe of my leasse of the Isles of Sillye from and after my Death with and under this proviso and
Condicion that the benefitt issues and Yearely proffittes growing Dew and arising out of the same shall be
received perceived and ordered by my Brother Fraunces Godolphin towardes the payment of my Brother
John Godolphin his Annuytie and towardes the use by me expressed in this Declaracion of my last will untill
my said sonne William shall accomplishe the age of one and Twentie Yeares, and if hee shall happen to
Dye before that Then the remainder of the said terme shall come and be unto my eldest sonne and heire,
that shall then be liveinge when hee shalbe of thage of one and Twentie Yeares, Item I remitt and forgive
unto my Cosen Symon Killegrewe all such Debtes as he shall owe me att the tyme of my Death, And as
concerninge such Debtes as Cosen Rich(ard) Bonithon oweth me he is better able to pay the same then
myne Can want it, All other my goodes and Chattells moveable and immoveable and whatsoever elles I
have by my will devisable and disposeable I referr to the disposicion of my Brother Fraunces Godolphin To
whome beinge confident of his iust and honest trust I wholy give and bequeath them and make him my
whole and sole Executor of this my last will and Testament and doe wholely relye upon his frugall Care
and providence for my posteritie takeinge the advise and assistance of my said Cosen John Coke Desyringe
them to take in theire remembraunce that as I came first by Corse of nature and before them, soe they
must allsoe yeald accompt before the great Judgment seate in theire tornes And in Case my said Brother
Fraunces Godolphin should runn the Course of all fleshe before my eldest sonne liveinge att his Death
shall be of the age of one and twentie Yeares, Then my will is and I Doe hereby substitute after him my
beloved Cosens Sir Robert Killigrew knight and Fraunces Bassett Esquier to be assisted with thadvice
aforesaid to execute Do Rule maunage governe and take Care of my estate and Children and to performe
this my will in every poynte in the substance thereof in as full and ample manner as my Brother Fraunces
Godolphin if hee were liveinge might Doe the same prayinge my said Brother not to alien graunt or Dispose
the remaynder of his foresaid terme of fowerteene Yeares, but that hee suffer the same to come unto the
said Sir Robert Killigrew knight and Fraunces Bassett Esquier to whome I Doe hereby give and bequeath the
Remaynder of the said Terme after the Deathe of my Brother Fraunces, and all such other goodes of myne
to my said Brother before Devised which shall remayne undisposed by him to be by them Disposed to the
uses before by me lymitted in this Declaracion of my last will and Testament and for the performance of
my intencions which I nowe Declare and before my Death shall Declare, Lastly I Doe hereby appoynte my
beloved Brother John Godolphin of Silly Fraunces Bassett of Tethedie and Fraunces Godolphin of
Treveneage Esquire to be my Overseers to see and Call uppon the dew performaunce of this my last will
and Testament, Item I Desire my said Executor to satisfie and paye unto my servant Richard Wilson the
somme of one hundred poundes in recompense of Fower score poundes which I Doe acknowled I Doe owe
him without specialtie , And Doe intreat him to make his stay with and to attend his little maister, Item my
Will is that my Apprentise Kelly be made a free man and that his Indentures be delivered up unto him and
all the rest of my servauntes to be retayned Dismissed and considered of as my said Brother and Executor
Fraunces Godolphin and my Cosen Coakes advise shall resolve on at my said Brothers comminge, Item I
Doe give unto my Cosen Honor Crudge Fiftie poundes by waye of increase over and above the legacie
given hir by my Father to be payd her at her marriadge, Item I would have my old servaunt William Gayre
to be restored to his former place in Sillye with my Brother John Godolphins liking And somthinge of the
value of fower or five poundes per Annum to be sought out and given unto him during his life, All which my
intencions I have Declared this second and fowerth Dayes of September in the Yeare of our Lord God 1613

The above written will was proved in London before the Venerable Master John Amye, Doctor of Laws,Surrogate of the Venerable Sir John Benet, knight, likewise Doctor of Laws, Master, Keeper or Commissary
lawfully appointed of the Prerogative Court of Canterbury, on the fourth day of the month of December in
the year of our Lord one thousand six hundred and thirteen, on the oath of Francis Godolphin, brother of
the said deceased, and executor named in the said will, to whom was granted the administration of the
goods, rights and credits of the said deceased, having been sworn on the Holy Gospels well and faithfully to
administer the same
