1. John Harris of Pickwell, Devon, esq. son and heir of Wm. Harris of Pickwell esq. decd.
2. Henry Arthur Herbert of Oakly Park esq. and Richard Herbert of Oakly Park esq. his younger brother
3. Dorothy Herbert younger sister of 2.
4. Coulsen Fellowes of Eggesford, Devon esq., Richd. Coffin of Postleaguw, Devon, esq., and Jas. Smith of Canonsleigh, Devon esq.
Marriage intended between 1 and 3
In consideration of 6000 paid by 2 to 4 as trustees,
To Uses:
To 1 till marriage then to 1 for life, then after his decease 2 to pay 3 500p.a. from the profits in 2 payments + 250 to be paid her immediately on decease of 1.
Remainder of estate (chargeable with the 500) to heirs of 1 and 3 in tail male. In default of such male heirs then to heirs of 1 for ever.
1 may lease out the properties to tenants
Concerning the 6000 paid by 2 to 4:- in trust to invest and pay interest to 1 for life and after death to realise the investment and divide amongst the younger children of 1 and 3 (excepting the eldest son) in proportions laid down by 1 in his will (none to get more than 3000) Any extra to go to executors of 1. Investments to continue till children of age and interest to go towards education and maintenance.
Recites will of Francis Herbert father of 2 and 3 and settlement of 20 July 1725 (20/14/77 and 20/14/80) The 4000 to be raised for 3 on the security of the Manor of Stanton Llanthony and other messuages etc. is now included in the 6000 above and the premises discharged of any further charge.

    Also capital mesuage, Barton Farme and demesne lands called Penterglaze in St. Minivers als. St. Miniford, Cornwall, also all the Manor or reputed manor of Hollacombe in Hollacombe in Devon with all messuages, lands and tenements belonging. Also the Maon of Kello and appurtenances in Devon.
    Also 1's moiety of Manors of Wortham and Upcott in Devon and Cornwall viz. moiety of the capital messuage Barton Farme and demesne of Wortham, Lifton, Deven and moiety of tenement called Carely, Lifton, Devon and moiety of Spry Mills, Stowford, Devon, moiety of 2 tenements in Spry Towne, Stowford, Devon formerly in tenures of Wm.
