Revd Frederick Hockin Clerk the Brothers the Executors to whom Admon was granted having been first

The Will of Elizabeth Hockin spinster of Phillack 1854
This is the last Will and Testament of me Elizabeth Hockin of the Parish of Phillack in the County of
Cornwall Spinster I give devise and bequeath
all my Property whatsoever and wheresoever to my two
brothers John Hockin of 8 Tokenhouse Yard in the County of Middlesex Esquire and the Reverend
Frederick Hockin of the Parish of Phillack in the County of Cornwall Clerk their heirs executors and
administrators according to the respective nature and quality thereof Upon the trusts hereinafter declared
(that is to say) Upon Trust that they and the survivor of them and the heirs executors or administrators of
such survivor or other the Trustees or Trustee for the time being of this my Will do and shall either
continue any monies or securities for money of or to which I may die possessed or entitled in their
respective actual state of investment or do and shall alter vary and transfer the same from time to time at
their discretion but so that all monies in the hands of my said Trustees or Trustee shall be kept invested
either in good Freehold or Leasehold Securities in England by way of purchase or mortgage or in the Stocks
or Funds or Government Securities of Great Britain and after payment of all my just debts and funeral and
testamentary expences as to a sum of One hundred pounds Upon Trust to stand possessed thereof
together with all accumulations thereon in the meantime for my Niece June Sampson Hockin [think typ for Anne Sampson] to be paid to
her on her attaining her full age of twenty Five years and as to a further sum of One hundred pounds Upon
Trust to stand possessed thereof together with all accumulations thereof in the meantime for my Niece
Deborah Margaret Hockin to be paid to her on her attaining the age of twenty five years and in case both
or either of my said Niece shall die before attaining that age the said several sums of One hundred pounds
so hereby bequeathed Upon trust for them or either of them so dying shall lapse into become part of the
Residue of my Estate and as to a further sum of One hundred pounds my Trustee or Trustees shall as soon
as conveniently may be after my decease pay the same to the Rector for the time being of the Parish of
Phillack aforesaid to be by him applied to the rebuilding restoration repairing or improving of the Parish
Church of that Parish and as to a sum of One thousand pounds sterling my said Trustees shall stand
possessed thereof Upon Trust to receive the interest dividends or other annual produce thereof and to pay
pay (
sic) the same to my Sister Emily Wife of the Reverend Henry Hymer Wright now of Pershore
Worcester for her sole and separate use and her receipts shall be sufficient discharges for the same
notwithstanding her coverture And in case she shall happen to die leaving a Child or Children her surviving
Then as to the said capital sum of One thousand pounds from and after her decease Upon Trust for such
Child or Children who shall attain their respective ages of twenty one years with such provision for their
respective maintenance in the meantime out of the interest dividends and annual income thereof at such
time or times and in such parts shares and proportions exclusively of any one or more of them and subject
as my said Sister Emily and her said Husband shall jointly appoint by Deed And in default of any such joint
appointment Then as the survivor of them shall appoint by Deed or Will And in default of any such last
mentioned appointment Upon Trust for such Child or Children equally as tenants in common and if but one
the whole to such one And in case my said Sister Emily shall die without leaving a Child or Children her
surviving or in case there shall be no such Child who shall attain his or her full age of twenty one years Then
from and immediately after the decease of the said Emily Wright or the decease of the survivor of such
Child or Children as the case may be my said Trustees shall stand possessed of the said sum of One
thousand pounds and the interest dividends and annual produce thereof Upon Trust to pay one moiety of
the interest dividends and annual produce to my said Niece Anne Sampson Hockin and the other moiety
thereof to my said Niece Deborah Margaret Hockin so long as they shall respectively remain unmarried
And in case both or either of them shall marry or shall have married with the consent of my said Trustees
or other the Trustees or Trustee for the time being hereof Then as to one half of the said Capital Fund of
One thousand pounds to pay the same immediately upon or as soon as may be after such marriage to
them or her marrying or to such person or persons as she or they shall appoint by Deed in full of all her
share and interest in the said sum of One thousand pounds and in default of such appointment or in case
both or either of my said Nieces shall die without having been married or shall marry without the consent
of my said Trustees or other the Trustees or Trustee of this my Will that their or her respective shares or
share shall immediately after their or her decease or marriage without the consent aforesaid remain and
be Upon Trust for my next of kin absolutely And as to
all the Residue of my property Real and Personal my
said Trustees or Trustee shall stand possessed thereof Upon Trust for my Sister Susan her heirs executors
and administrators absolutely And I hereby appoint my said Brothers John and Frederick to be the
Executors of this my Will And I declare that my said Trustees and Executors or other the Trustees or
Trustee of this my Will for the time being shall not be responsible one for the other or others of them nor

for involuntary losses and that it shall be lawful for them to reimburse themselves respectively all costs
damages and expences whatsoever which shall be incurred in executing the trusts of this my Will and that
their respective receipts shall be good discharges for all monies which they shall receive by virtue hereof
and shall exonerate all persons paying the same from being liable or bound to see To the application
thereof and that if they or either of them or any other Trustee or Trustees of this my Will shall die or desire
to be discharged from or become incapable of acting in the trusts of this my Will Then and as often as the
same shall happen it shall be lawful for the surviving or last acting Trustee or his executors or
administrators by Deed to appoint a Trustee or Trustees in whom all my Trust Estate shall thereupon be
vested either solely or jointly with the surviving or continuing Trustee or Trustees as occasion shall require
and every such new Trustee shall have all the powers and authorities of the Trustee or Trustees in whose
place he or they shall be substituted In witness whereof I have to this my Will written on three sheets of
paper set my hand at the foot or end of each sheet this nineteenth day of August One thousand eight
hundred and fifty four
Elizabeth Hockin Signed and acknowledged by the said Elizabeth Hockin as her last
Will and Testament in the presence of us present at the same time who at her request in her presence and
in the presence of each other have subscribed our names as witnesses

This is a Codicil to my last Will and Testament I bequeath to my Brother Williams Hockin the sum of £100 I
bequeath to my Brother John Hockin the sum of £100 I bequeath to my Mother my interest of the Estate of
Puldack August 19
th 1854 Elizabeth Hockin In presence of Margaret Furber Christian Gartrell
In the Prerogative Court of Canterbury In the Goods of Elizabeth Hockin Spinster deceased
Appeared personally Christian Gartrell of Phillack in the County of Cornwall Widow one of the subscribed
Witnesses to the Codicil to the last Will and Testament of the said Elizabeth Hockin late of the Parish of
Phillack in the County of Cornwall Spinster deceased the said Will and Codicil being hereunto annexed and
bearing date respectively the nineteenth day of August One thousand eight hundred and fifty four And the
Appearer having now inspected the said Codicil made Oath that on the said nineteenth day of August the
said Testator duly executed the same by signing her name at the foot or end thereof in the presence of this
Deponent and of Margaret Furber Spinster the other subscribed witness thereto who were both present at
the same time and this deponent and the said Margaret Furber thereupon attested and subscribed the said
Codicil in the presence of the said testatrix and of each other
Christian Gartrell On the ninth day of June
1856 the said Christian Gartrell Widow was duly sworn to the truth of this Affidavit By virtue of the
annexed Commission Before me
