DEED is made the sixteenth day
of March One thousand nine
hundred and seventy three B E T W E E N ST AUSTELL BREWERY
COMPANY LIMITED whose registered office is situate at The Brewery
St.Austell in the County of Cornwall (hereinafter called "the
Company") of the one part and WALTER FRANCIS EDGE and ROSEMARY
EMMA EDGE Number 3 Victoria Cottages Angarrack
COMPANY LIMITED whose registered office is situate at The Brewery
St.Austell in the County of Cornwall (hereinafter called "the
Company") of the one part and WALTER FRANCIS EDGE and ROSEMARY
EMMA EDGE (his wife) both of Edge Hill College St. Helens Road
Ormskirk in the County of Lancaster (hereinafter called "the Grantees
of the other part. _______________________________________________
(1) The Company is seised in fee simple of property known as The
Angarrack Inn Angarrack Hayle in the said County of Cornwall which
for the purpose of identification only is delineated and shown edged
brown on the plan annexed hereto. ———————————————
(2) The Grantees are seised in fee simple of a cottage known as
Number 3 Victoria Cottages Angarrack Hayle aforesaid which for the
purpose of identification only is delineated and shown edged blue an
the said plan.———————————————
(3) The Company has constructed a sewer or drain with the requisite
manholes (hereinafter referred to as "the Company's drain") the
approximate course of which is shown in yellow on the said plan to
connect The Angarrack Inn to the main public sewer the approximate
course of which is shown in green on the said plan. —————————
Number 3 Victoria Cottages") has been constructed by the Grantees'
predecessor in title with the consent of the Company in the.
approximate position shown in red on the said plan to connect Number
3 Victoria Cottages to the Company's drain at the manhole marked "A"
sum of One pound to grant to the Grantees such rights as are
hereinafter described. .———————————————
(the receipt whereof the Company Hereby acknowledges) the Company as
beneficial owner hereby grants unto the Grantees :
- Full right and Liberty to use the Company’s drain in common
with the Company its successors in title and all other :
persons haying the like right for the passage or conveyance
of sewage water and soil from Number 3 Victoria Cottages —
aforesaid but not for any other purpose whatsoever. - Full right and liberty for the purpose aforesaid but not
for any other purpose whatsoever to maintain repair and
renew the drain serving Number 3 Victoria Cottages and its
connection with the Company's drain at the manhole marked.
"A" on the said plan together with all necessary rights of
access on to the property of the Company provided that the
Grantees shall make good at their own expense all damage
or disturbance which may be caused to the property of the

2. IT IS HEREBY AGREED AND DECLARED that the Company and the Grantees
or their respective successors in title shall each pay a fair
proportion according to use of the cost of maintaining repairing or
renewing the Company's drain such proportion in case of dispute to
be ascertained by a single arbitrator appointed under the
Arbitration Act 1950 or any statutory modification or re-enactment
thereof for the time being in force. —————————
3. THE Company hereby acknowledges the right of the Grantees to the
Production of a Deed of Conveyance and Assignment dated the Thirtieth
day of March One thousand nine hundred and thirty five and made
between Christopher Ellis & Son Limited in liquidation of the first
part Kenneth Alfred Edgar Moore of the second part Hester Parnall]
Reginald Garrould Barnes Susan Hicks Caroline Hicks Kate Hoyle
George Hicks Christopher Ellis and John Ellis of the third part
and the Company of the fourth part and to the delivery of copies
thereof and hereby undertakes with the Grantees for the safe custody

4. IT IS HEREBY CERTIFIED that the transaction hereby effected
does not form part of a larger transaction or of a series of
transactions in respect of which the amount or value or the aggregate
amount or value of the consideration exceeds the sum of Ten thousand
